1. DEFINITIONS

Each term beginning with a capital letter below has the meaning given to it in its definition in this article.

‘Terms of Use’: refers to this document.

‘Special Terms and Conditions’: refers to the terms and conditions of use specific to certain Services taken individually.

‘Services’: refers to all or part of the services provided by La Poste to Users and accessible via the Website. The Services include, in particular, the information made available to Users as well as the services for preparing shipments, tracking shipments and calculating postage costs.

‘Website’ refers to the portal website accessible at www.lapostegroupe.com/fr and/or any other address that La Poste may substitute or add to it.

‘Users’ refers to any natural or legal person using one or more Services.

2. PURPOSE

This document constitutes the Terms and Conditions of Use for the Services. The purpose of this document is to define the terms and conditions of use of the Services by the User. It is specified that use of the Services is subject to compliance with these Terms and Conditions of Use as provided for in the following article.

3. HIERARCHY, ACCEPTANCE AND MODIFICATION

3.1 Hierarchy

La Poste provides the Services in accordance with these Terms of Use. Certain Services may have their own terms of use (the Special Terms) which supplement the Terms of Use.

The Special Terms and Conditions form an integral part of the Terms and Conditions of Use. If the terms, conditions and provisions of the Terms and Conditions of Use conflict with the Special Terms and Conditions, these Terms and Conditions of Use shall prevail.

3.2 Acceptance

La Poste provides its Services to you on condition that you agree to comply with these Terms of Use. We advise you to refer regularly to the latest version of the Terms of Use.

In any event, you are deemed to have accepted them simply by using the Services. Any use of the Services implies acceptance of the latest version of the Terms of Use.

3.3 Modification

The Terms of Use may be modified at any time by La Poste. In this case, the modified Terms of Use shall take effect as soon as they are posted online. We recommend that Users read the Terms of Use regularly. Users are deemed to accept the latest version each time they log in to the Services.

REGISTRATION FOR SERVICES

In order to use certain Services, you must complete a registration form and provide information about yourself. You agree to provide accurate, complete and up-to-date information. If the information provided is inaccurate, incomplete or out of date, La Poste will take any measures it deems necessary to suspend your access to the service concerned, either permanently or temporarily.

5. PERSONAL DATA

The User expressly consents to the processing of personal data concerning him/her that is collected as part of the registration procedures for certain Services, solely for the purposes of those Services.

In accordance with the provisions of the French Data Protection Act of 6 January 1978, La Poste undertakes to use the User's personal data only for the purposes specified above. La Poste expressly undertakes not to process data in a manner incompatible with the purposes of the Services, and not to publish, disclose or transmit information concerning the User without their prior consent.

In accordance with the provisions of the French Data Protection Act of 6 January 1978, the User has the right to access, rectify and delete personal data concerning him/her, which may be exercised at the following address : dircom.rgpd@laposte.fr

La Poste guarantees that personal data will not be transferred to third parties. This guarantee does not apply to processing for statistical or historical or scientific research purposes, in particular in the context of sociological or scientific studies, provided that the processing in question only addresses the data in an anonymous and aggregated manner.

La Poste undertakes to implement appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorised disclosure or access.

La Poste undertakes to retain personal data for a period not exceeding that necessary to achieve the purposes for which it is collected or processed.

La Poste may be required to disclose any information about you in order to comply with any law or regulation in force, or to respond to any judicial or administrative request.

La Poste recommends that you exercise the utmost caution when sharing data about yourself on communication services (messaging, chat, forums), as such data may be collected and used by third parties without your knowledge.

6. COOKIES

La Poste reserves the right to use cookies in order to ensure the best possible management of the Services, to facilitate your navigation of the Services and to compile statistics. If you wish, you can refuse cookies by modifying your browser settings, in most cases in the “preferences” section.

7. USERNAME AND PASSWORD

To access certain Services, you will need to use a username and password. Your password is personal and confidential. You agree not to disclose it to any third party in any form whatsoever and for any reason whatsoever, and to immediately inform La Poste of any unauthorised use by a third party and any security breach that may result. You are solely responsible for keeping your password confidential and for any use that may be made of it.

8. CHANGES TO SERVICES

La Poste reserves the right to modify or temporarily or permanently discontinue all or part of the Services without prior notice to the User.

9. COST OF ACCESS TO SERVICES

The Services are accessible via the Internet for the most part, or via other means of communication for some. The costs of connecting to the Services are borne by the User.

10. USE OF SERVICES BY MINORS

When the User is a minor, they declare that they have obtained authorisation to use the Services from the person(s) with parental authority over them and that the person(s) with parental authority have agreed to guarantee the minor User's compliance with the Terms of Use. Any use of the Services by a minor User is carried out under the full responsibility of the person(s) with parental authority over the User concerned.

11. USE OF SERVICES BY THE USER

You agree to use the Services in accordance with national and international regulations, and in particular not to use them to display, download, send or transmit any content: · of a violent nature or likely to undermine respect for and dignity of the human person, equality between men and women, and the protection of children and adolescents, in particular through the production, transport and dissemination of messages of a violent or pornographic nature or likely to undermine human dignity; · that encourages the commission of crimes and offences; · that incites the consumption of prohibited substances; · that provokes or may provoke discrimination, hatred or violence on the grounds of race, ethnicity or nationality; · that is illegal, harmful, threatening, abusive, harassing, defamatory, insulting, vulgar, obscene, threatening to the privacy of others or likely to offend the sensibilities of certain individuals; that misleads other Users by misappropriating the name or corporate name of other persons; · that infringes the rights of third parties, including, but not limited to, any manufacturing secret, professional secret, confidential information, trademark, patent and, in general, any industrial or intellectual property right or any other right relating to protected information or content; · that includes, without limitation, computer viruses or any other code or programme designed to interrupt, destroy or limit the functionality of any software, computer or telecommunications tool.

You agree to :

  • Regularly review the Terms of Use and comply with them ;

  • Do not collect or store personal data relating to other Users ;

  • Do not harass one or more other Users in any way ;

  • Do not interfere with or disrupt the operation of the Services.

12. ACCESS RESTRICTION

In the event of any breach of these Terms of Use on your part, access to the Services will be automatically blocked, without prejudice to any legal action that may be taken by La Poste and any damages that may be claimed from you.

13. LINKS

The Services may contain links to websites of partners of La Poste or third parties. La Poste has no control over these websites and therefore assumes no responsibility for the availability of these websites, their content, advertising, products or services available on or from these websites.

14. RELATIONSHIPS WITH PARTNERS AND ADVERTISERS

Any commercial relations that you may enter into when using the Services with La Poste's partners or advertisers present on the Services are conducted directly with the partners or advertisers, without La Poste being a party to these relations. Consequently, La Poste cannot be held liable for any damage suffered by the User as a result of their relationships with La Poste partners or advertisers.

15. INTELLECTUAL PROPERTY RIGHTS

Content such as, but not limited to, texts, information, documentation, audio files, photographs, drawings, plans, trademarks, software packages, software, data, databases, graphic charters, visuals, avatars, and more generally any element appearing on the Website and/or available on the Services, is protected by intellectual property law without the express authorisation of La Poste and/or its partners.

16. TRADEMARKS

The trademarks appearing on the Services are protected trademarks of La Poste and/or its partners. Any reproduction or use of these trademarks without the express authorisation of La Poste and/or its partners is strictly prohibited.

17. WARRANTY

You agree to indemnify La Poste against any action brought against it, or any complaint filed against it, by a third party, as a result of your use of the Services, or use of the Services under your username and password, in a manner that does not comply with the Terms of Use. This indemnity covers any sum that La Poste may be required to pay for any reason whatsoever, including reasonable legal fees and costs, within reasonable limits. The use of the Services is not accompanied by any warranty whatsoever. La Poste makes no express or implied warranty as to the use of the Services by the User, including the availability, timeliness, accuracy, reliability and usefulness of the Services and their content.

Similarly, La Poste does not guarantee that the content and services obtained by the User on the Services will meet their expectations, or that the content and services provided comply with any regulations or third-party rights.

18. LIMITATION OF LIABILITY

You are responsible for the use of your username and password. All connections to the Services and data transmissions made using your username and password will be deemed to have been made by you. These provisions remain applicable even if you pre-register your username and password on your computer, thereby enabling automatic connection to the Services. The User declares that they accept the characteristics and limitations of the Internet and, in particular, acknowledges that they are aware of the nature of the Internet network and, in particular, its technical performance.

La Poste cannot be held liable in any way whatsoever, including but not limited to, in the event of modification, suspension or interruption of the Services.

La Poste cannot under any circumstances be held liable for the reliability of data transmission, access times, or any access restrictions on the Internet or networks connected to it. La Poste cannot be held liable in the event of interruption of the networks providing access to the Services, total or partial unavailability of the Services resulting in particular from the telecommunications operator, in the event of transmission errors or problems related to the security of transmissions, or in the event of failure of the reception equipment or your telephone line.

La Poste may be required to interrupt its Services for maintenance reasons. This interruption will be notified by means of a warning on the home page or by any other means. La Poste shall not be held liable for this interruption under any circumstances, and it shall not give rise to any right to compensation.

Under no circumstances shall La Poste be held liable for indirect damages, including commercial, moral and financial losses, including any loss of profits caused by, originating from or based on the use of the Services or their content.

La Poste assumes no responsibility for the use of the Services or their content. The content and services provided by La Poste's partners through the Services are provided under the sole responsibility of La Poste's partners. La Poste is therefore in no way liable for any direct or indirect damage arising in particular from the User's access to or use of the Services, from the non-compliance of the Services or their content with any regulations, or from any infringement of the rights of third parties.

You are solely responsible for all content (including text, images or sounds) that you communicate to any third party through any of the Services, whether transmitted in a public or private context. Consequently, La Poste cannot be held liable for content communicated by Users via the Services.

19. VARIOUS

If any clause is deemed null and void, it shall be deemed unwritten and shall not invalidate the other clauses. Failure by La Poste to exercise any of the rights resulting from these Terms of Use shall not constitute a waiver of its rights.

20. APPLICABLE LAW - JURISDICTION

Any dispute arising from the interpretation and execution of these Terms of Use shall be subject to an attempt at amicable settlement. In the absence of an amicable settlement, the dispute shall be subject to French law and brought before the competent court within the jurisdiction of the Paris Court of Appeal, ruling in accordance with French law.
